YOUR CONSUMER ACCOUNT.
To access and register on the Website as a Consumer, You must register for a Consumer Account with Us (“Consumer Account”). You agree to provide true, accurate, and complete information to Us and on all registration and other forms You access on the Website and to update such information to maintain its truthfulness, accuracy, and completeness. You must not provide misleading information about Your location. Upon Consumer Account registration, and from time to time thereafter, Your Consumer Account may be subject to verification as well as editorial and feedback reviews. Once You have registered and activated Your Consumer Account You may begin placing bids by clicking “Submit Bid” on the Website (each, a “Bid”) or service requests by clicking “Request Bid” on the Website (each, a “Service Request”).
BID REVIEW – WHAT HAPPENS NEXT.
Once a Consumer submits a Bid or Service Request, Bidology will search for Local Service Providers to either accept the Bid or respond to the Service Request. If a Local Service Provider clicks "Accept Bid" and provides the Local Service Provider’s payment schedule, Bidology will provide an alert to the Consumer that the Bid was accepted. If a Local Service Provider clicks “Respond to Request”, Bidology will provide the Local Service Provider’s response to Consumer. Consumer then has the option of accepting, rejecting or providing a counteroffer to the Local Service Provider’s response. Once the Consumer reviews all accepted Bids or Service Request responses, the Consumer will select the Bid and Local Service Provider that best fits their needs. Once a Bid is accepted, We'll immediately charge the credit card You provide to Us. Please note, You will not be provided with a list of Local Service Providers. Also, please remember that once You click "Submit Bid" Your Bid cannot be changed, cancelled, or transferred and refunds are not allowed. If We cannot find a Local Service Provider willing to accept Your offer, Your credit card will not be charged. Bidology’s service is different from other service directory sites. With Bidology's bidding platform, the accepted Local Service Provider is shown only after they have reviewed and accepted Your Bid. While Bidology will use its good faith efforts to respond to Bids within the time periods indicated on this Website, no guarantee is made that the status of Your Bid will be made available to You within the stated processing time. Neither Bidology nor its Local Service Providers are responsible for any errors or delays in responding to a Bid including, without limitation, error or delays in responding to a Bid caused by an incorrect e-mail address or other data provided by You or other technical problems beyond their control. Percent savings claim applies to provided Local Service Provider standard rate charges only. There is no guarantee that prices will be available. Actual prices and availability are always subject to change. All prices and dates may be subject to change by the local service provider and savings are not guaranteed. All sales final.
All Bids are non-refundable, non-cancellable and non-changeable. At the time Your Bid is accepted, Your method of payment will be charged for the amount shown, regardless of whether or not the LSP Services are used. Credit will not be given for any unused LSP Services and cannot be used toward any future purchases. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this Website. In connection with facilitating Your transaction, the charge to Your payment method will include a charge for taxes, as applicable.
Bidology may monitor Your use of the Website and use data and information related to such use in an aggregate and anonymous manner, including to compile statistical and performance information related to the provision and operation of the Website and services therein (“Aggregated Statistics”). As between Bidology and You, all right, title and interest in the Aggregated Statistics and all intellectual property rights therein, belong to and are retained solely by Bidology. You acknowledge that Bidology will be compiling Aggregated Statistics based on Your input into the Website and You agree that Bidology may (a) make such Aggregated Statistics publicly available, and (b) use such information to the extent and in the manner required by applicable law or regulation and for purposes of data gathering, analysis, service enhancement and marketing, provided that such data and information does not identify You or Your Confidential Information.
You agree to defend, indemnify and hold harmless Bidology, its subsidiaries and affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including, without limitation, attorneys’ fees, arising out of, related to, or in connection with any of the following: (a) any LSP Services purchased by You through the Website or any additional products or services purchased or obtained by You from the Local Services Provider; (b) any User Submission submitted or posted by You, in connection with the Website, or any use of the Website in violation of these Terms; (c) fraud You commit or Your intentional misconduct or gross negligence; or (d) Your violation of any applicable laws or rights of a third-party. You are solely responsible for Your interactions with Local Service Providers and other users of the Website. To the extent permitted under applicable laws, You hereby release Bidology from any and all claims or liability related to any products or services of a Local Service Provider, any action or inaction by a Local Service Provider, including, without limitation, any harm caused to You by action or inaction of a Local Service Provider, a Local Service Provider’s failure to comply with applicable law and/or failure to abide by the terms of LSP Services or any other product or service purchased or obtained by You from the Local Service Provider, and any conduct, speech or User Submission, whether online or offline, of any other third-party.
Bidology reserves the right to modify, suspend or terminate Your Consumer Account and/or Your rights to access and use the Website at any time. Bidology shall not be liable to You or any other third party for any such modification, suspension or termination of Your rights to access and use the Services. You may opt-out of further communications with Us at any time.
Information We Collect
We collect personally identifiable information ("Personal Data") about you that you provide to us while using the Site. Personal Data is information that can identify you as a specific individual, such as your name, address, phone number, credit card number or other payment information, or email address. We will also collect any information that you otherwise provide to us, such as your company name or comments that you submit through our Site. We also collect non-personally identifiable information, including your IP address, domain name, access time and time spent on our Site, referring URL, age views, search preferences, location, and bids through your interactions with our Site.
How We Use Your Personal Data
Bidology may use Personal Data for customer service purposes, such as to provide you with products and services; for administrative, research, and development purposes, such as to build features that will improve our services; to communicate with you about your use of our Site and services and to provide you with information that we think may interest you, such as special offers; and to comply with applicable legal obligations.
How We Share Your Personal Data
Bidology may share your Personal Data as described below:
Vendors: We may disclose your information to our vendors, agents, or others who perform functions on our behalf. For example, we may use vendors to help us handle email, analyze the data we collect, and market our services.
Unaffiliated Third Parties. We may disclose your Personal Data to other unaffiliated third parties, including for their own marketing purposes. Please see our Special Information for California Consumers section below with regard to such disclosures.
Business Transfers: Our business is constantly changing. As part of that process, Bidology may sell or buy other companies, and Personal Data may be transferred as part of these transactions. It is also possible that Bidology, or substantially all of its assets, may be acquired by another company, whether by merger, sale of assets or otherwise, and Personal Data may be transferred as part of such a transaction.
Compliance with Law and Other Disclosures: Bidology reserves the right to release Personal Data in order to comply with applicable laws, regulations and other legal requirements; when we believe that disclosure is necessary to comply with a judicial proceeding, court order or other legal process served on us; or as evidence in litigation in which we are involved.
Aggregate and De-Identified Information. We may disclose aggregate or de-identified information about users for marketing, advertising, research, or similar purposes, such as reporting on pricing trends.
Cookies and Other Tracking Technologies
Do Not Track: Our Site does not respond to Do Not Track signals and we may track your activities once you leave our Site. You may disable certain tracking as discussed in this section (e.g., by disabling cookies).
Clear GIFs, Pixel Tags and Other Technologies: Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, which are embedded invisibly on web pages. We may send periodic promotional or informational emails to you. You may opt out of such communications by updating your marketing preferences in your profile or following the opt-out instructions contained in the email. Please note that it may take up to ten (10) business days for us to process opt-out requests. If you opt out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your account or any Services you have requested or received from us.
Our Site is intended to be used by customers located in the United States. If you are located anywhere outside of the United States, please be aware that information we collect about your, including Personal Data, will be transferred to, processed and stored in the United States. The data protection and privacy laws in the United States differ from those of the country in which you are located. Persons under the age of 18 are not eligible to purchase, cancel or modify any services available through Bidology. If we discover that a person under 18 has provided us with Personal Data, we will promptly delete such information from our systems.
We have taken steps to help protect the information we collect about you from loss, misuse, unauthorized access, disclosure, alteration and destruction. However, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your account by, among other things, choosing a robust password that nobody else knows or can easily guess and keeping your log-in and password private. We are not responsible for any lost, stolen or compromised passwords or for any activity on your account via unauthorized password activity.
Special Information for California Consumers
California residents may request a list of certain third parties to which we have disclosed certain types of Personal Data for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response.
